Aggravating factor for sentencing

8.22In addition to a new offence, we recommend an amendment to the Sentencing Act 2002 to achieve the objectives described above.

Recommendation

8.23This amendment would send a clear signal from Parliament that strangulation must not be treated lightly and may increase culpability. In this way, it would raise awareness amongst the judiciary and suggest to judges that sentences should be calibrated accordingly.
